Judge Madeline Hughes Haikala throws out excessive force case against a police officer because "All Lives Matter"

Per the Ruling:  Two juries have communicated as much after lengthy deliberations that produced thoughtful questions and, ultimately, deadlock. The Court has no reason to expect a different result in a subsequent trial given the totality of the evidence that the parties have provided. The Government has had two full and fair chances to obtain a conviction; it will not have another.

Let's recap:
Madison police last week roughed up a 57-year-old Indian citizen who was walking on the sidewalk outside his son's home, leaving the older man temporarily paralyzed and hospitalized with fused vertebrae.
"He was just walking on the sidewalk as he does all the time," said his son, Chirag Patel, this morning. "They put him to the ground."
No crime had been committed. Madison Police on Monday issued a statement saying the department had suspended the officer and were investigating the use of force in this case. The police statement wished the man a "speedy recovery."
It's the victims fault the police treated him like a skinny black guy in America.
Defense attorney Robert Tuten this time told the jury that the escalation of force was largely the fault of Patel.
"When you come to the U.S. we expect you to follow our laws and speak our language," said Tuten. "Mr. Patel bears as much responsibility for this as anyone."
The first trial deadlocked in a mistrial  10-2 in favor of acquittal along racial/gender lines.


The jury that couldn't reach a verdict in the criminal trial of police officer Eric Parker was split 10-2 along gender lines, according to one of the holdout jurors.
Ten men wanted to acquit the officer who slammed down a 57-year-old Indian citizen during a sidewalk stop, leaving the man partly paralyzed.
The two women on the jury thought Parker was guilty of the federal civil rights charge, deprivation of rights under the color of law. The charge carries a sentence of up to 10 years in prison.
When contacted by al.com, one of those two women explained the two-day deliberation that ended in frustration for both sides. "I was the one saying he was guilty," said the juror, who asked to withhold her name.
The juror, who is retired from the U.S. Army, said from Thursday morning through late Friday no jurors changed their minds and extra time seemed unlikely to alter the deadlock. "It was 10 to 2. I wasn't changing my story."
The jury also appeared to split along racial lines. Both female jurors were black. None of the 10 male jurors were black.
U.S. District Judge Madeline Hughes Haikala today ordered that, unlike during the first trial, media will not be allowed to report or blog from the courtroom. Reporters will be allowed to take handwritten notes and report after they leave.
The second trial deadlocked in a mistrial.
The new jury was flipped, packed with nine women this time and just three men. The new jury had four black members, including the foreman. 
There will be no third trial because the judge was troubled by the federal focus on race.   
"I said to you at the first trial, and I don't think I said it explicitly at this one, but I did say that I did not want there to be racial issues in this trial," said Haikala.She said the discussion came up during jury selection, as the government used all its strikes to block white males from sitting on the jury.
She said the "all lives matter" comment and the talk of shooting an unarmed man from behind "is right on point with all of the racial discussion that is going on," said Haikala. "The court finds it troubling that the government is resorting to those sorts of tactics."
Blame it on the media 
But Judge Haikala mentioned a news story on al.com, a story she had brought up in transcripts before. The story contained interviews with jurors from the first trial. The first jury deadlocked along racial and gender lines, with 10 white men finding Parker innocent and two African American women voting guilty.
"The media coverage portrayed this as a racial issue and so I thought I was very clear about the fact that it be improper for race to be an issue at any level in this case," repeated Judge Haikala.
Later on Nov. 4, after the second jury announced they could not reach a consensus, the defense moved the judge for an acquittal.
"This is the second jury that's obviously had a hard time reaching a decision in this case," said Tuten. "I think that speaks to the proof and lack of proof that has been offered by the government and I think it illustrates that have not made a prima facie case."
So now we know.  If someone calls police to complain of a skinny black guy who is just kind of walking around close to the garage, the police have the right to reasonably assume that the individual was involved in a burglary.  But it's not racial.

For those who remember the recent Baltimore-based Fox News affiliate WBFF’s deplorable attempt at misrepresentation of peaceful protests in the midst of the Black Lives Matter movement dominating the country since the murderers of Michael Brown and Eric Garner were cut loose of any charges, a petition is now being circulated calling for those responsible for the devious misrepresentation to be fired and for the station to receive large FCC fines.

Change has come to some of the Alabama Airways!


I make a concerted effort to be in my car from 12-3 PM CST, Monday-Friday so I can listen to Keeping it Real with  Rev. Al Sharpton on XM 169 The Power.  Imagine my surprise when a the guest host identified a caller listening on WEUP AM radio in Huntsville, Alabama!!!  We don't have to listen to all Ru$h and Company, and all  Ru$h Wanna Bees  all the time anymore and I don't have to drive around to hear liberal talk!

Finally, conversation about social and political issues from the liberal prospective!  There is a saying, he/she who controls the message controls the outcome.   Why do republicans control the outcome?   Because they control the media.

Any media that dares report the truth is labeled liberal, like that's a bad thing.  In an effort not to appear liberal, the media adopted the false "fair and balanced" narrative.  It ought to be against the law to use the airways to misinform the public.  But it's not.  An informed electorate is an educated electorate.

It's not the Fairness Doctrine, but it's a start!  Liberals/progressives in Dothan, Alabama can listen to Keeping It Real on WAGF AM 1330, M-F, from 12-3 PM.   Keeping It Real is pending in Montgomery and Mobile. So stay tuned!  Tennessee Valley listeners can also listen online to conserve gas. :)

Edit~I Told You Terri Sewell was Artur Davis in Designer Pumps

The winner of the democratic congressional primary from the one and ONLY Alabama district President Obama carried in 2008 has announced I'm not going to be a rubber stamp for Obama.

I tried to tell y'all
Terri didn't pledge to vote in the interest of the voters of the district. She round about said she would vote against Nancy Pelosi and President Obama. Why would Nancy Pelosi and President Obama introduce legislation that wouldn't be in the interest of the 7th district?
But I was accused of inventing a straw man, making sh*t up, and peddling hypocrisy (I'm looking at you mooncat, countrycat, Kathy, Kayman, et.al)

So you can knock it down. In other words you're making shit up.

You weren't in the audience Thursday so I know you have no idea what Terri Sewell said, but you obviously feel free to twist my words. She unequivocally said her first priority would be the needs and wishes of the 7th congressional district. When pressed, she said even the President could not convince her to vote against the interest of her district. Nor could partisan politics. That's a very strong statement of loyalty to the voters who elect a representative. Under normal circumstances you would praise a representative who vowed to actually represent We the People, but for some reason you are now looking for reasons to criticize it.

I need hip boots for the hypocrisy you are peddling.
What a difference a day makes. Yesterday Terri Sewell was quoting Shirley Chisholm, today she's sounding like the rest of the Alabama Congressional Critters.
"I'll be a partner with Obama" to "By no means will I just rubber stamp any and all policies of the administration"
This is what happens when the republicans enabled by the media and neo liberal bloggers choose the democratic nominee from the 7th district.

If the Alabama democratic party was courageous, and I'm not saying they are, they would run an independent against Ms. Nine West Pumps in November. The residents of the 7th district deserve better. They are the most loyal voting block the state and national democratic party has, it's time to stop taking their loyalty for granted.

What is on my mind Wednesday.

If 50 Teabaggers showed up to protest President Obama or Congressman Parker Griffith (r. traitor) I'll bet there would be wall to wall media coverage complete with live interviews, but since according to al.com, it was only 50 progressive, democratic outcast protesting Dubya's former *ahem* advisor the media we have barely yawned. Thank goodness we have a real media outlet to tell us what really happened duringKKKarl Rove's trip to Sweet Home Alabama. Compare and contrast the coverage. It's like night and day. But I'm not surprised, are you?

Speaking of Bushes Brain aka KKKarl Rove, his base is repackaging their movement in a new, multicultural wrapping. Yeah right. Same stuff, different robe.

Speaking of media coverage, or the lack thereof, check out Booman's version of What if the Tea Party were black.
What would happen if we took, say, a couple hundred nicely dressed black men, to a gun show out in rural Anywhere, U.S.A.? What if we came in a couple of busloads, legally purchased firearms and left in a quiet and orderly fashion, just as we'd come. What kind of news coverage, if any, would we get?


Uh Oh! The Mainstream Media fired a warning shot at President Obama today. This is the same media who enabled Bush and Dick to send our troops to Iraq based on DEAD WRONG Intelligence, remember? What BlatantLiberal said!
I'm outraged over this meaningless story for one reason: health care. We saw this most clearly with the death panel lie. That is not a failure of communication or messaging. That was a failure of the mainstream media to educate the people. It speaks to the systemic and endemic failure of the media to simply report. And that is not the White House's fault; it's the fault of a media that will allow lies to take hold. That is willing to report a lie and give it the same billing as the policy itself warping the public's knowledge and facts.

Paging the Alabama ACLU!!! We've got another prom situation in Dixie. This time it's in Calhoun County Alabama.

"Oxford High School, a school in Calhoun County, Ala., prom dress codes are strictly enforced. Some say too strictly. This year, the Anniston Star reports that 25 students were disciplined for violating the prom dress code. The strangest part of the story, though, is that the students were allowed to stay at the prom, but the following week, they had to choose the option of receiving corporal punishment (by paddling) or a three-day suspension....The principal, Trey Holladay, defends the policy stating that, "We're using the same policy we've had for the last five years. Being a parent, I want to make sure girls and guys act accordingly. We're a high school, and our community has certain expectations of what is appropriate."


So much discrimination, so little time.

The Morning Health Care Reform Scare, I mean Spin.

I begin each day by tuning in to Morning Joke, I mean Joe on MSNBC to see what the TeeVee Pundit Head Talking Point of the Day will be before switching over to Washington Journal on C-Span to see what we the peeps are talking about. You would be surprised at the disconnect between the MSM TTPH's and we the peeps. Or maybe not.

The MSM TTPH Talking Point for Tuesday March 30, 2010 is....drum roll please....56% of the American People polled don't like Health Care Reform. Who did they poll? The Tea Baggers? Republicans? I mean, really?

Maybe they polled my mothers next door neighbor. A white, middle aged, divorced, stay at home mother of three, conservative, christian, die heart republican, who doesn't have health insurance because when she and her husband divorced she was no longer eligible to be on his health insurance. Oh, I forget to tell you she also has epilepsy, which means she couldn't buy health insurance because it's one of them there "preexisting conditions".

Over the weekend my mother's neighbor suffered an epileptic seizure and suffered a head injury. She went to one of the Emergency Care Centers for treatment and was told since she didn't have insurance she would need to pay $200.00 up front. She said she didn't have $200.00 but could pay them $50.00 and pay them so much a month. They refused her offer. So what did she do? You guessed it. Proceeded straight to the evil, socialized, government run, Hospital Emergency Room for treatment. And guess who pays for that, but I digress.

Anyway, after she told her story, my mother said, "Now aren't you glad President Obama signed that health care bill?" And she said "No, it won't help me any". My mother said "Well at least this way they can't turn you away because you don't have insurance." And I piped in and said "Now you can purchase health insurance and they can't turn you down because you have epilepsy." And she said, "It's just a government take over of the health care system and they are going to raise our taxes to pay for it." Which let me know, it's not about health care. It's about President Obama. It's about the misinformation and the scare tactics promoted by the republicans and their media enablers.

President Obama is being called a Socialist because he wants people to have access to quality affordable health care.

President Obama is compared to Hitler (who exterminated millions of people) because he wants people to have access to be able to go to the Doctor when they get sick and not be turned away because of an inability to pay.

According to the media/polls, 56% of the American people don't like President Obama. Strike that, 56% of the American people POLLED by the POLLING POLLSTERS don't like President Obama. It's not about health care reform

But what about the 44% of the American people who weren't polled? What about the millions of American who voted for President Obama and elected him President? What are we? Chopped liver? Don't we count? The polling pollsters should tune in to Washington Journal and hear real health care stories from real people. People who like health care reform. People who need health care reform. People who voted for health care reform. People who like President Obama.

President Obama wants to help make this world a better place of everybody. Even the 56% of Americans who don't like health care reform. Strike that, even the 56% of Americans who the MSM TTPH (who have access to quality health care btw) tell us don't like health reform.

So much hypocrisy, so little time.

The War on Terra Continues. A NATO airstrike mistakenly killed 28-30 people today. I'm with StevenD, How much longer is this madness going to continue? When will enough killing and bombing be enough? Bring our troops home. Bring them home now.
So why are we repeating the same mistakes made by other "super powers" of the past? In a time of extraordinary economic decline for most Americans we continue to pour precious resources into a conflict that we cannot "win" whatever "metric" one uses to measure "winning."
Congress should immediately reinstate funds to ACORN. This knee-jerk action by Congress was a travesty. It's been proven the whole Pimp story was a right wing funded set up and lie. ACORNS only crime was being a community organizing group. They need to go after the real Pimps, but of course they won't. That would be to much like right(pun intended).
O'Keefe got big accolades from a lot of the CPAC speakers and of course ACORN got ripped up one side and down the other.

Sometimes I think some of the elected people in DC never read anything and instead rely on each other regarding what to think. They jumped all over ACORN without really looking into the whole case.

I thought I read somewhere that a judge had said the govt. had to give ACORN the money they had already been promised.
Instead of going after ACORN they need to go after stuff like THIS.
Voters trying to cast ballots in Lower Oxford Township East stood in lines for so long that TV crews showed up to capture the scene. Some of those waiting ordered out for pizza. Sympathetic neighbors brought water and coffee. When the last vote was cast shortly before 11 p.m., polls were officially closing on the West Coast and Barack Obama had already been declared the winner.

Some of the 1,440 who voted there that day waited for seven to eight hours in the rain, queuing up close enough to working railroad tracks to reach out and touch passing freight cars. The tiny community center they waited to enter could accommodate only seven booths and one optical scanner. The adjacent parking lot was big enough for a dozen cars.

This wasn't a mistake. It was deliberate. It was the clearest example you could hope to find of partisan politics trumping common sense and civic duty.

Listen up Democrats! Bipartisanshop=Appeasement. When are you going to learn that appeasement doesn't work? It's not wise to appease republicans. It's how they turn the winners into the losers and the losers into the winners.
The theory is that if Democrats make a show out of reaching out to Republicans, but Republicans slap Democrats down every time and obstruct for the sake of obstructing, then Democrats will gain politically.

The reality is that Republicans gain in the polls if Democrats fail to pass legislation that improves people's lives, no matter the political theater of obstruction.
Thanks to the democratically controlled Congress, President Obama is afraid to lead. Seriously. They've made him afraid of the far left liberals, who have been right about everything from the war to the deficity in favor of the so called moderates and independents. The President's Healthcare Bill and What is Missing is proof.
There’s no public option in the Prez’s proposal which is a shame since polls show that the majority of Americans want a public option (such a dumb phrase), as good as say… Medicare or VA health benefits or even the government-sponsored program in which Sarah Palin’s son Tripp is hypocritically enrolled. The audacity of that woman — what’s good enough for her son is evidently not good enough for other Americans, it would seem.
Sarah Palin is the Hypocrit of the Decade.
As we all know, Sarah's suffering for her family is boundless, but this must be the worst of all. What is difficult to understand is why she doesn't use this most personal example of the horrors of government run health care in her public cries to prevent Obamacare. She normally isn't one to suffer in silence; maybe someone in the media will ask her to share the nightmare that her daughter must endure knowing, all day every day, that her son will receive health care regardless of her ability to afford it. Or maybe not.
Tiger Yoo? While the MSM was breathlessly parsing every word of Tiger Woods apology they totally ignored the story about John Woo and the Massacre Memo
In John Yoo's vision of executive power, the president can legally order a village of civilians "massacred," according to the internal Justice Department report released Friday.
The MSM calls Glenn Becks wild eyed rant *cough cough* Brave Criticism of the GOP. Give me a break.
Take a look at these headlines.

WaPo: “At CPAC, Glenn Beck scolds the Republican Party.“
MSNBC: “Beck criticizes Obama and the GOP.“
The Atlantic: “Beck Thumps GOP, Puzzling Conservatives.”
L.A. Times: “Glenn Beck to Republican Party: Repent.“
And on and on. If you only skimmed those headlines, you’d think that Beck went boldly into the belly of the beast, and had some kind of Sister Souljah moment.

Except Beck didn’t do that. He blew smoke up the CPAC audience’s white asses by simply reciting, verbatim, exactly the same tired spiel Republican leaders have been parroting nonstop since they lost control of Congress in 2006.

All White is Not Right (pun intended)

We can no longer ignore the elephant in the room (yes that's another pun),or, as one of my list serve buddies says, "It's time to pull the sheets off the "Tea Baggers" and call them what they really are."

'REPUBLICAN' while the Republican Party tries to chave it's image and present
itself as less extreme.

If PALIN is going to lead that party, that is EXACTLY WHAT IT IS;

In the aftermath of the so called Tea Party convention this weekend, we can no longer ignore the FACT the members are ALL WHITE and they despise President Obama. Sure they have a couple of token blacks so they can claim they are "diverse", but the majority of the members are white and bitter.

Yes I said it. They are bitter because they are afraid. They are afraid because they've been terrorised. They are bitter because they've been misinformed (lied to). They are clinging to their God and their guns out of pure unadulterated fear or retribution and retaliation for their past sins and transgressions. Black folks are going to pay them back for slavery and Jim Crow. Native Americans are going to get them for taking their land and giving them small pox. Hispanics are going to take over. Lesbians and gays are going to come out of the closet and be allowed to marry. Women are going to be allowed to kill their babies. The heathens and the unwashed are going to take our bibles and our guns. Get my drift?

This is what happens when the all white is not right media allows the public airways to be used to spread misinformation (lies) without impunity. This is what happens when the media lacks cultural diversity. This is what happens when the media censors and suppresses dissent. All fear all the time UNfair and Unbalanced, all terror all the time UNfair and UNbalanced,all war all the time UNfair and UNbalanced thrives when there is no truth.

What do you think the media would have said if after the selection of pResident George W. Bush guns sales boomed among Black folks?

"Definitely, it's because of Obama," said a saleswoman at Freddie Bear Sports in Tinley Park. The saleswoman, who declined to give her name, said that the boost is more for the "long guns," like AK-47s and assault rifles.


What if large groups of black folks organized into a Tea Party like movement and called George W. Bush a "socialist"?

Comedienne Janeane Garofalo held nothing back while discussing the “tea parties” with Keith Olbermann last night. Though the parties’ organizers claim they’re protesting taxes, Garofalo insists they’re nothing but “tea-bagging rednecks” who are simply motivated by “hating a black man in the White House.” She went on to say that participants “will believe anything you tell them, as long as it’s not the truth.” The truth, she claims, “confuses them.”

Olbermann basically agreed.


Compare how former Vice President Al Gore was treated by the media and in the media compared to Sarah Palin. Al Gore didn't become a paid, Faux News Talking TeeVee Pundit Head. He certainly was not the de facto leader of an organized movement giving red meat speeches against Bush and Dick.

Palin was mocking, asking, "How's that hope-y, change-y stuff working out for you?" and she was serious, especially while criticizing what she judged to be President Obama's too-measured approach to national security. A country at war, she said, needs "a commander-in-chief, not a professor of law."
Palin was folksy. Sticking our kids with the bill for deficit spending is a form of "generational theft" that makes us less secure, makes us less free, "and that should tick us off." Sure, solving the country's problems is tough, she added, but "If you can't ride two horses at once you shouldn't be in the circus."


The only black folks on TeeVee this Sunday morning are talking about the Super Bowl. There are no African American, Hispanic, native American Talking TeeVee Pundit Heads or host of cable talk shows. We used to be able to count on C-Span for diversity and fairness, but they've fallen prey to the all white is right rule too.

Until and unless we start having some real fairness and balance in the media, tea party groups will continue to thrive. Until and unless we have a free press that informs the public instead of distorting what we decide we will continue to send our sons and daughters to war based on dead wrong intelligence.

We can no longer ignore the elephant in the room.

All white is not right.

It's the stoopid.

Not talking about the racism isn't going to make it go away

Let's address it, not suppress it.

It's the Stoopid Media, Stupid!

I know you're probably tired of hearing me say this, but I keep saying it because it's true. The MSM we has is largely responsible for influencing public opinion and shaping public policy. As President Obama said in the SOTU address, the media has turned politics into a game of gotcha, right wing talking points and all spin all the time. Instead of telling us what we need to know, they tell us what they want us to know. For example, we know more about Bill Clintons' private parts than we do about 911. Why?

This is the media who allowed Bush and Cheney to take us to war based on DEAD WRONG INTELLIGENCE. This is the media who allowed Bill Clinton to be impeached for trying to conceal a private, consensual, extra marital,sexual affair from his wife, his daughter and the country. This is the same media that marginalized and minimized the anti war protesters as anti Americans who don't support our troops, but legitimize the Teabaggers as a "grass roots" movement. This is the media that claims it's being fair and balanced when they are actually UNfair and UNbalanced.

It seems to me more and more that the Democrats and the Obama administration
lack a comprehensive media strategy to explain and promote their agenda,
policies and programs. They have left it up to the increasingly active tea party
movement and promoter such as Fox News, Right wing talk show and cable networks
of all stripes to tell the American people what President Obama and the
Democrats are all about.



It's not only Fox News and other right wing media outlets, it's CNN, MSNBC and even C-Span. CNN is so busy trying to prove it's not "liberal" they've turned into Fox lite. MSNBC treats us to three hours of misinformation with ex republican Congressman Joe Scarbrough first thing every morning. We used to be able to count on C-Span to at least be fair, if not balanced, but the so called liberal Washington Post has been replaced with the conservative Washington Times as the newspaper of record and conservative leaning Politico.com is the blog of record and conservative/right wing groups and talking heads out number and out debate the democratic/liberal counter side. All of them have a noticeable lack of cultural diversity i.e. it's all white unless the minorities are conservatives.

They have allowed the President to have his face grotesquely smeared on posters
all around the country, House leader Pelosi and Harry Reid's name used as a
pejorative by Fox News day in and day out.


I would add they also allowed President Clinton, Hillary Clinton, the late Senator Edward Kennedy, Reverend Jeremiah Wright, and liberals in general to become a dirty word. If anyone dared protray Bush is a negative light they screamed bloody murder. Republicans=good. Democrats=bad.

Democrats could not explain their health bill in a way the American public could
understand.


Democrats reigned in the credit card companies last summer, then gave the same
companies six months to raise before the law kicked in.

Democrats failed to create a consumer protection agency.
The Democrats failed to create a Deficit reduction commission.

The democrats passed a stimulus bill and then let the right wing and cable news
pick it apart.

The democrats passed the Tarp and other laws and actions without adequately
explaining what would have happened if that had not been done.

With all the so called big money donors, why the lack of any media buys
explaining the Democrats and Obama's accomplishments?


Why indeed? The President and the democrats need to stop taking a knife to the gunfight and take the big guns instead. The current group of people who are allowed to present the message on TeeVee have failed and failed miserably. They are not effective. POTUS needs new, strong, bold faces on TeeVee speaking on behalf of the people, like Howard Dean, Rep. Maxine Waters, Rep. Dennis Kuchinich and other effective progressives and liberals. Someone who isn't afraid to take on the right wing bullies. In sports lingo, they need to send in the second string. ASAP.

One example that could have been effective is a simple chart showing which U.S
President had the highest deficit during their terms. This chart from zFacts
clearly shows the trend between cumulative federal debt and the economy during
each presidential term since Truman.

The writer concludes;

The republicans, conservatives, corporations have a simple formula for winning
elections.
1. Appear to be for the middle class while doing the corporate bidding.
2. Embrace the moral issues (always votes there)
3 Strong military defense (men like guns and war- Male Vote)
4. Use fear of immigrants (brown, black) White and Asian are OK.
5. Use fear of Debt and deficits even though Republicans presidents such as
Reagan and Bush ran up more debt than any other previous presidents.
6. Count on the voters not reading or knowing history.

When will the progressives and liberals get their own Cable network to mirror
Fox News but from the left? The way things are going, liberals are disheartened
and disappointed and the right wing smells blood in the water.

When will progressives and liberals get our own Cable network and talk radio programs? How long are we going to continue to allow the public airways to be used to spread misinformation and to distort what we decide?

It's the media I tell you. The media thinks we are stoopid. They think they can tell us anything and we will believe it. It ought to be against the law to use the public airways to lie to the American people.

Why Does Everybody Hate Obama?

Poor President Obama, he thought when he was inaugurated as the first African American President of the United States America was ready to move forward and break the chains of the past. He thought hope had won over fear. He thought we would all join hands and sing in the words of that great Negro Spiritual "Free at last, free at last, thank God Almighty we're free at last". Not.

Now I'm not saying President Obama didn't bring some of this on himself. He pi$$ed off LBTS's with Rick Warren. He pi$$ed off the anti war crowd with the Afghanistan surge. He hasn't closed Gitmo as promised. He won't investigate Bush and company. He hasn't restored honor and integrity to the justice department. He won't directly address the sorry state of race relations. Don't ask don't tell is still in effect. Mortage forclosures are still on the rise. We have massive job loss. The banks got a bail out but not main street. Health care reform is in limbo. This is not the change we hoped we voted for in November 2008.

President Obama extended his hand to his enemies and drew back a nub. Rush Limbaugh said he wanted President Obama to fail. Republican Senator Jim DeMint of South Carolina said health care reform was President Obama Waterloo. Chris Matthews said he was going to do everything in his power to help President Obama be successful and was told by Joe Scarborough that wasn't his job.

Then came the birthers, and the deathers and finally they just joined forces and became the Tea Party movement.

As if that wasn't enough, President Obama has to fight with his own damn party! Between the DINO's (democrats in name only) and the blue dogs (democrats in name only) he's under assault on the right and on the left.

Then he has to deal with the republican controlled Supreme Court that says corporations should are people with rights. I always knew gop stood for Greed Over People.

Jill Tubman lays the blame at the feet of the democratic party. Talia Whyte agrees and says the real conversation is not about what Republicans are doing, but what the Democrats are not doing. Specifically, there is an urgency to discuss why we in the black community continue to allow white Democrats that take us for granted.

Does everyone hate President Obama, do do they hate what and who he stands for? Is he not being allowed to govern because of the color of his skin or the content of his character? Is this about good old fashioned American racism?

I say yes. It's about not wanting that guy to succeed. Because if he succeeds it will open the door for future Barack Obamas and whites can no longer say blacks are incapable of governing.

So, now that we know, what can we do about it? How can we help President Obama help us? I say we take a page out of the gop play book and organize. I say we take a page out of the tea baggers play book and take it to the streets. We can fight back in the media by not suppressing progressive voice, it's time to put the big dogs on TeeVee. I say don't get mad, get even.

Sometimes a loss is a victory.

Do you think loosing a filibuster proof majority in the Senate will be a wake up call to the democratic party? (We the people did our part and they squandered it).

Do you think they are going to continue doing the same old stuff hoping for a different result? (Losing in Virginia and New Jersey didn't tell them anything?)

Do you think they are going to grow a spine? (Never underestimate the power of fear and racism)

Do you think they are going to keep silencing progressive voices and criticism? (Put voices from the democratic wing of the democratic party on TeeVee and radio, bring out the big guns and stop taking a kitchen knife to the gunfight)

Do you think they are going to keep rewarding failure and continue to appoint and promote the Brownie's who managed and directed this heck of a job disaster? (We WON with Howard Dean, remember?)

Do you think they are going to continue to misunderestimate the power of the new and improved teabagger infused gop and their media enablers? (Enuff said)

Do you think they are going to continue to let the media and the pollsters spin the message and turn the winners into losers and the losers into winners? (Democrats WON in November, remember?)

Do you think they are re-arranging the deck chairs on the Titanic, or do they have an escape plan? (Is it time to get rid of the filibuster?)

If tonight's loss stikes fear in the belly of the democratic party then tonight's loss is a victory. If it's doesn't then we're all in trouble.
