Reasonable Doubt for Dummies!



A broke clock is right twice a day, and every once in a while our resident righty FED UP gets it right(pun intended), as in this comment regarding the pending execution of Troy Anthony Davis, even though the case against him as fallen apart.

FED UP said;

You DO NOT know that he did not commit that crime and I do not know that he did!

This my friends is REASONABLE DOUBT for Dummies. This is why Troy Davis should not be executed. This is why Troy Davis should be granted a new trial. This is why I am against the death penalty.

Troy Davis and the politics of death.
Troy Davis has three major strikes against him. First, he is an African-American man. Second, he was charged with killing a white police officer. And third, he is in Georgia.

More than a century ago, the legendary muckraking journalist Ida B. Wells risked her life when she began reporting on the epidemic of lynchings in the Deep South. She published “Southern Horrors: Lynch Law in All Its Phases” in 1892 and followed up with “The Red Record” in 1895, detailing hundreds of lynchings. She wrote: “In Brooks County, Ga., Dec. 23, while this Christian country was preparing for Christmas celebration, seven Negroes were lynched in twenty-four hours because they refused, or were unable to tell the whereabouts of a colored man named Pike, who killed a white man ... Georgia heads the list of lynching states.”
None dare call it racism, but the fact remains there are more blacks than whites on death row, because they're well....black.

Barring some miraculous intervention by Gov. Rick Perry, Duane Buck will become the 11th person to be executed this year in Texas’ death chamber and the execution will be wrong—not because of some anti-death penalty view I may have but because his death sentence was definitively the result of race.
Buck, an African-American, was convicted in 1997 for the 1995 double murder of his girlfriend and her companion. During Buck’s 1997 trial, his defense attorney called a psychologist named Walter Quijano who testified during the punishment phase of the trial and who, upon cross examination by prosecutors with the Harris County District Attorney’s Office, stated he believed that because Buck was black, he posed a greater risk of “future dangerousness” in the prison setting. Future dangerousness is a critical factor a capital jury must consider in deciding whether the death penalty is appropriate in a given case.
In 2000 U.S. Senator John Cronyn, then Texas’ attorney general, said that Buck’s case was one of six his office had identified in which Quijano had introduced race into jury deliberations. Then Attorney General Cronyn said that all of the condemned inmates were entitled to a new punishment hearing. Five of those inmates was given new punishment hearings by various federal courts which resulted in each being re-sentenced to death. One of the five has been executed.
Neither state nor federal courts ever ordered a new punishment hearing in Buck’s case. Why Buck’s trial attorney would call a psychologist who had a history of injecting race in the trial process is not readily available in the public record. What is known is that state and federal courts over the last few weeks have rebuffed the determined efforts by Buck’s current attorneys, David Dow and Katherine Black, to secure a new punishment hearing. The Fifth Circuit Court of Appeals yesterday denied Buck’s last legal opportunity to get a new punishment hearing.


Is Duane Buck guilty of the crimes he was convicted of? Yes. Should he be executed because he's black? No. And FED Up, before you tune up your spin machine, just because I oppose the death penalty doesn't mean I want rapist and murderers to go free, or live among civil society. It means I want them to spend the rest of their natural lives in behind bars. I oppose the death penalty because I'm pro life. For real.

Under Politics 101, a conservative governor, especially in Texas, would not intercede in a case that has been rejected by the courts and the pardon board. But these are not normal political circumstances. Gov. Perry is running for the presidency of the United States and has already faced serious media questions about his refusal to stop the 2004 execution of Cameron Todd Willingham, despite compelling evidence indicating the condemned inmate was innocent. The Buck case offers the governor an opportunity to redeem himself, especially among African-Americans who believe the death penalty in Texas unfairly targets blacks. A thirty-day reprieve would not cost the governor a single point among his conservative political base because chances are the courts would not order a new punishment hearing during the reprieve period and the pardon board most certainly would not. Thus, the only thing a reprieve would probably accomplish is a few more months of life for Duane Buck—an insignificant price considering the good will the governor would benefit from granting the reprieve.
As I said in my opening, barring some miraculous intervention by Gov. Perry, Buck will be executed tonight.


Thou Shalt not Kill. That means everybody.
The primary reason God hates murder is that out of all creation, only human are made in the image of God (Genesis 1:26-27; 9:4-6). Even before the codification of the Ten Commandments at Mount Sinai the murder of other human beings was wrong (Genesis 4:8-12; 4:23-24; 9:4-6; Exodus 1:16-17). While on earth, Jesus spoke out against murder (Matthew 5:21-26; Mark 10:17-19). We also see in the writings of Paul (Romans 1:18, 29-32; 13:8-10; Galatians 5:19-21), James (James 2:8-11; 4:1-3), Peter (1 Peter 4:15-16) and John (Revelation 9:20-21; 21:7-8; 22:14-15) that murder is wrong.

Why are people not outraged and more vocal about what is going on with Huntsville City Schools? Instruction is not the focus and the new Super is ruining employees lives daily with no regret. He talks constantly about recruiting excellence from other states as though current employees have no talent or value. People should be screaming about what is going on. You can't rule by making people afraid of you. This is awful!!

blacks also serve on jurys. jury of your peers!!

Take away the convictions and look at the subject listed as an offender/suspect for crimes committed and you will see who is listed more than anyone else. Alot of those crimes are black on black with a black victim saying a black offender/suspect did it! You can run and tell that

Anon, I believe there is no outrage because
1. people don't know what's going on.
2. Those who do now what's going on are afraid to speak up for fear retaliation\retribution.
3. The majority of the school board are in the pocket of special interest.

The new Superintendent is referred to as Hitler and he is hiring a lot of out of state personnel.

I do read Geek's blog and find that it is accurate and factual. How sad that we live in fear in 2011. Right is right and wrong is wrong. This man is wrong! How sad his employees must feel that he is now seeking principals from national sources (as though there is no talent currently in the system or in our state); that a someone was hired to handle schools scoring a certain score and someone one else was hired to supervise those that were not (read between the lines); that he purposefully degrades his employees and other are afraid to speak; and that he moved an administrator go Providence MS knowing it would be closing (is he the next one to be let go...he better connect the dots if he thinks otherwise). There are clear common factors here and the public should be outraged. No other local school system has these problems (personnel, law suits, special education, etc). The board is elected and answers to the public. It is a out children and Hitler Wardynski is clearly not. It's time for the revolution to be televised!

The “New Century Foundation” studies Federal crime reports, and found significant differences in crime ratio between races, verified by the FBI’s NCVS, National Crime Victimization Survey, and The Department of Justice’s UCR, Uniform Crime Reports, FBI Communication’s Division, 304-625-4995.

They state emphatically that the Judicial System is not biased against minorities.

Blacks are seven times more likely than people of other races to commit murder, and eight times more likely to commit robbery.

Blacks are three times more likely to use a hand gun, and twice more likely to use a knife.

Hispanics commit three times more violent crimes than whites, but the statistics are nebulous because sometimes they are classified as white, so it could be far higher.

The best indicator of violent crime levels in an area is the percent of the population that is black and Hispanic.

Blacks are 39 times more likely to commit a violent crime against whites then vice versa, and 136 times more likely to commit a robbery.

Forty-five percent of black crime is against whites, 43 against other blacks, and 10 percent against Hispanic.

People need to turn off their TV and start to read and become aware of what's happening in this country.

Hey Red,

Can you pub more about the school system? Pretty "interesting" that we have another person from Colorado in our midst. The new deputy superintendent and her husband have been visiting the area since early august looking for homes. Her hubby is a member of a local group that showed them around. Wake up people...this was planned a long time ago! She wouldn't move for what they offered thus the increase. Where is the media. Either they are a part of this cover up or asleep at the wheel. She doesn't "look" like Casey, but will clearly be loyal to him (since he paid her an insane amount of money to come here)!!

More info...she is making over $7000 more than the max salary advertised when the position offered. It was never discussed at a Board mtg, but easily approved by Topper, Jeannie, David, Lori, and Alta. More underhanded lies, while teacher make the minimum with no hope of a raise. People are losing there jobs daily and this woman walks in with a $7000 raise?????

CBC Chair admits that black people only like Obama because he is black.

Recently members of the congressional black caucus[CBC] railed against Obama during speaking tours. Some said they couldn’t put the pressure on Obama that they really wanted to for fear of angering other blacks.

The the CBC chairman, Rep. Emanuel Cleaver (D-MO), says that if Obama was white the black community would be marching on the White House right now.

Cleaver is the same militant race hustler who fabricated a story about TEA Party members spitting on him and calling him racial slurs. The media widely reported his claim as a fact. Video of the incident show that the claim was a complete lie. After whipping local black supporters into a frenzy of anti-white hatred, a bunch of young black males rampaged through Kansas City, MO attacking and spitting on random white victims.

Cleaver’s comment demonstrate that the CBC, not the TEA Party movement, only see the world from a racial/tribal viewpoint.

But the group’s efforts are freighted with political sensitivities, given Obama’s unique role as the first African-American occupant of the White House and the sometimes untethered animosity that his election has triggered.

“If (former President) Bill Clinton had been in the White House and had failed to address this problem, we probably would be marching on the White House,” Cleaver said. “There is a less-volatile reaction in the CBC because nobody wants to do anything that would empower the people who hate the president.”

The black caucus has 43 members who come from nearly two dozen states. Its concerns about black unemployment are not Cleaver’s only frustration these days.

One member of the caucus, Democratic Rep. Andre Carson of Indiana, recently said that tea party members of Congress “would love to see you and me … hanging on a tree.” Another, Democratic Rep. Maxine Waters of California, told a community meeting that the tea party “can go straight to hell.”
