Being a recipient of Welfare is NOT probable cause

Once upon a time in the land of the free and the home of the brave, aka The United States of America, there used to be this little thingy called Probable Cause to protect we the peeps from Big Government.
In United States criminal law, probable cause is the standard by which an officer or agent of the law has the grounds to make an arrest, to conduct a personal or property search, or to obtain a warrant for arrest, etc. when criminal charges are being considered. It is also used to refer to the standard to which a grand jury believes that a crime has been committed. This term comes from the Fourth Amendment of the United States Constitution:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
That was the case before the start of TeaPublican Revolution with Florida Gooverner Rick Scott(TeaPublican) firing the first shot.
Florida's Republican governor has invoked the fury of privacy advocates after signing into law a bill requiring welfare recipients to undergo drugs tests.
Rick Scott is already facing a lawsuit filed by the American Civil Liberties Union of Florida seeking to half a similar order mandating drug testing for state employees.
The ACLU has slammed the law as an 'extreme overreach' of his powers. Officials are considering a similar lawsuit over the welfare bill, which he signed into law yesterday.
I wonder what part of

This is the same group who is always screaming about the 2nd amendment and accusing the Guvermint of trying to disarm them.

Stoopid argument of the decade
If even ONE person is receiving public aid and using that aid to purchase drugs, it’s one person too many. Taxpayer money should not go to financing destructive and irresponsible choices. The argument isn’t that welfare recipients use more or less drugs, just that the state wants to ensure NO ONE does!
I say if welfare recipients have to drug tested, the *ahem* Lawmakers who receive public money, and Radio/TeeVee Talking Pundit Heads who use the public airways, ought be tested too. Taxpayer money should not go to financing destructive, irresponsible choices and using the public airways to misinform the public.

I think you should have to pass a random drug test maybe 3 times a year to get assistance!!! Why not? It's not a right to get assistance,it's a privilege when you fall on hard times!! It's also meant to be a temporary solution but we have families on welfare for years and generation after generation!! When you expect a handout you will never better yourself. Most people today want a handout not a hand up!! Is it my constitutional right to want my tax money used in a good way not for people on drugs or doing drugs. These people use the welfare check for drugs. They also take vacations on the ebt cards. There has to be something done. I'd like a limit to how long you can collect welfare. I also think you should be on birth control if you receive so the American people do not have to take care another mouth! Maybe we should make each family member pay their taxes for their own family members on welfare! It's not my job to feed and cloth someone else or their family!! My job is to take care of my family not yours! Yes I give to United Way and other charities. I do not mind to help someone who is down but I do mind if they never try to improve themselves and rely on welfare. We have to many FREE programs to better ones self so there is no need for more than 24 months on welfare!!!!!!!!!!!!!

It is not a crime to be a welfare recipiant.
I don't like my tax dollars being used to bomb people but it's the price I pay for the right to life, liberty and the pursuit of happiness in the land of the free and the home of the brave.

Fed Up, have you ever heard of paragraphs? They help break up the text into more manageable chunks, so it doesn't become a tedious exercise reading one single block of text. Perhaps you should use them more often.

I suppose mandatory drug testing for welfare recipients is supposed to make the recipients feel like criminals and common scum. I doubt this will make a dent in the supposed number of people who are using these benefits for drugs, as anyone who was doing so would have sense enough to either clean themselves days before the test or pass someone else's piss for their own. And there's also the possibility of officials passing individuals in return for pocketing the money that'd supposedly be "refunded" after passing the test.

I can't wait to hear about the single mother who got her benefits cut off because the tests flagged her as positive for marijuana, all because she happened to pass by someone puffing a joint or had to put up with her baby daddy smoking blunts in the house.

BTW Fed Up, I wish you and others of your speed were this vocal about runaway military spending. I'm fed up (HAHA, get it?) with seeing my hard-earned taxpayer dollars being wasted on the "graveyard of empires", Afghanistan. Wrap that shit up and bring those troops home.

If it's good for the proverbial goose to be drugged tested, it's also good for the gander, and for the gaggle of politicians who live to deprive us of our Constitutionally-guaranteed freedoms--be they local, state, or federal.

I'd take it one step further: Anyone receiving money from the government should be compelled to be drug tested--corporations receiving subsidies, state officials receiving stimulus money, and certainly those assisted by FEMA when a disaster strikes.

Hell, why stop there: Require everyone in the country--from sea to shining sea, and from the southern border to the northern border, including non-contiguous states, such as Alaska, and Hawaii, and the commonwealth of Puerto Rico--to be tested at least twice a year, if not more often: Once before April 15, and once after April 15.

Why April 15?

It's on this date that the national insanity rate increases, and people's frustration level reaches its peak in their pursuit to do their patriotic duty--that is, pay their taxes to fund corporate subsidies, never-ending wars, mandatory drug testing, and the salaries of state and federal representatives.

I am also tired of my money being spent on war. The majority of the middle east do not want us there anyway!

I'd like to see the manpower put on the borders and the streets to clean up America.

There is also a thing called reasonable suspicion that police can have in order to investigate a situation. They do not need probable cause all the time,just reasonable suspicion.

If America stopped the war stopped all this free welfare to people who have been on it more than 2 years, stopped supporting illegals with FREE welfare and healthcare,stop giving money away to other countries, etc we would pay the debit off and have money left. America could prosper again!

You say racial profiling so are you saying blacks and hispanics make up the largest percent of welfare recepients? I do not think we should have welfare at all and at the least just fo 12-24 months and no more!! It has become a life long memebership for many! Imagine the money save if we did that! We would not be in as much trouble finance wise as we are now!

Welfare is not the cause of the massive debt this country faces. We spend more on war and foriegn aid than we do on our own people. And who are you to say how long someone should receive assistance? What do you want them to do....die quickly?

No, I do not want them to die. I want the ones who are able to get the free education they can get,go to trade school,learn a skill etc so I do not have to provide for them for their whole life!!!!!! We have many who need our help I do not mind that. I do mind the ones who get welfare and drive a better car than I do, the ones who travel on their ebt card,the ones who eat at Outback Shogun etc. If you are struggling you need to use it for food clothing etc not for HIGH priced food, vacations etc. I too want to quit all the spending on the war as well as prisons housing inmates who have been given the death penalty, put them to death already and save the money of housing them,the ILLEGAL immigrants welfare check, free healthcare,etc. STOP all that and we would be in BETTER shape!

How do you know welfare recipiants aE driving a better car than you? Why don't you take advantage of your free education and get a better car and go eat at outback if thats what's worrying you. Again, what gives you the right to impose your values on others? Live and let live.

By the way Fed Up, I have a law degree and I can assure you it's not a constitutional right to want your tax dollars used in a good way. Whatever subjective standard a "good way" is. People use their pay checks for drugs, so do the clowns we elect. What's your point. Let's drug test congress and the senate, when they pass the morality test then I will worry about the so called leaches.

By the by, if you haven't been reading, which it seems you haven't, if employer's aren't hiring and they haven't been hiring since 2008, which is 24 months ago...get the picture?

This law is racist on it's face, because people like you, who believe in stereotypes and believe that only minorities only use welfare and they are the only ones that commit crimes, etc... this creates another way to racially profile.

MY POINT is no one should be on welfare generation after generation. We know that happens! Why? It should not happen with all the free programs to get and education or trade!I'm just saying that if you need assistance but you use it to go on vacations or eat at fancy places then you must not be as bad off as you say. I drive through places in Huntsville and see BMWs suvs etc all in Butler Terrace, North woods and Mason Court!

I do agree congress and the senate should have more strict standards, like having to use the healthcare plan they passed and also have to go by all rules passed, term limits etc

My point is nobody would be on welfare generation after generation if it weren't for republican policies. People on assistance as you call it have just as much RIGHT to go on vacations and eat at fancy places as any other American.

And why are you driving through Butler Terrace and Mason Court looking at what kind of cars are parked there? Have you thought it might be the CITY/STATE/COUNTY/FEDERAL Employees automobiles parked in the parking lot? Have you thought it might be a VISITOR's automobile instead of a residents? And even if it is the residents so effing what?

Again we wouldn't have so many people needing assistance if it were not for republican policies like all war all the time and tax cuts for the rich, while cutting education funding and sending jobs overseas.

Republicans hate so called illegal immigrants except the ones who work for them. Ride around and see how many immigrants are working on the highway construction crews, construction, landscape management, and other service jobs while you're riding around looking.

After you finish looking around there, go up to the County jail and see how many African Americans are locked up for non violent crimes because they can't find a job because they dropped out of an under achieving high school.

he unemployment rate for African Americans is 19%. If that were the rate for white Americans republicans would be screaming bloody murder and RIGHTLY so.

Speaking of republican policies where are the freaking jobs they said they were going to create? How many jobs did the Bush tax cut for the rich create? Why are the republicans obstructed President Obama's agenda at every turn, including job creation bills?

republicans need to lead, follow or GTF out of the way.

What do you suggest for those who commit non violent crimes? Do we not enforce the laws? The bottom line is this......DO NOT COMMIT A CRIME, then there is nothing to worry about!!! When are you going to comment on my other post june 6 2011 6:30 am the one just above these.

I just opened the Huntsville Times and they have plenty of jobs listed. I am quite sure all papers have numerous jobs listed so don't give me that BS.They either do not want to work,are not looking in the paper,internet or out job hunting, or it's bcause they get a free check every month so why work?!!!

Really Fed Up? I have been unemployed for over a year. I have a law degree, no children but I have had no job offers. It's not so simple as look in the paper, you have a screwed up view of life and I sincerely hope bad events dont ruin your life and change your sanctimonious attitude.distrec

Are you willing to move? There are factors that you can change to get a job. I just looked at jobs on line and their are plenty seeking someone with a law degree! Are you a lawyer? You can teach law with a few more classes. You may have to work in retail or sales or Mcdonalds until you get the job you want. There are plenty of jobs in roofing over the road truckers etc There are plenty of jobs you can do!!! It may not be what you want but in theses hard times take what you can get!!!!!!!!!!!!!!!!!!! My point is still the same we do have jobs but no one wants to do them,maybe they are not willing to work that low paying job until they find a better one then if so that's on them!!

First of all fed up there is a limit on welfare it's 5 years and just because I do or don't get welfare doesn't mean I'm on drugs. There are plenty of people not on welfare that are on drugs. You sound like a fool but that's your opinion and where do you see black people and white people going to the same schools but for in the projects... Learn before you speak.
